These Terms of Service ("Terms") govern your access to and use of the website located at kaleidoskystudio.com, as well as any content, features, and services provided by Kaleidosky Studio LLC ("Company," "we," "us," or "our"). By accessing, browsing, submitting content to, placing an order, or using our website or services, you agree to be bound by these Terms.
We provide professional real estate media services, including but not limited to photo and video editing and enhancement; virtual staging and object modification; floor plan creation; 3D modeling and 3D animation; architectural visualization and renderings. All services are performed remotely using client submitted materials or specifications.
Services are performed using a combination of professional software tools and artificial intelligence assisted technologies. Client acknowledges and agrees that Delivered Media may involve digital enhancement, alteration, virtual staging, object removal, lighting adjustments, color adjustments, compositing, or other modifications generated or assisted by automated systems. Delivered Media is intended solely for visual and marketing purposes and does not represent factual guarantees regarding the current condition, dimensions, materials, or features of any property. Client remains solely responsible for compliance with all MLS, brokerage, advertising, and disclosure requirements related to edited or virtually staged media. Original Client Media and Delivered Media are not used to train public or third party artificial intelligence models without Client's prior written consent. Kaleidosky Studio retains all rights to its internal workflows, tools, methodologies, presets, and AI processes used to produce the services. Client is responsible for promptly reviewing Delivered Media and must notify Kaleidosky Studio in writing of any inaccuracies, errors, or misrepresentations within a reasonable time after delivery, so that we may make reasonable corrections consistent with the original instructions.
You represent and warrant that:
You retain full ownership of all original photos, videos, plans, or files you submit ("Original Client Media"). Upon full payment and delivery, you retain full ownership and usage rights to all final edited images, videos, renderings, animations, or floor plans delivered by Kaleidosky Studio ("Delivered Media").
You grant Kaleidosky Studio a limited, non-exclusive license to use both Original Client Media and Delivered Media solely for portfolio, marketing, and promotional purposes, including Before and After comparisons that demonstrate our services, unless you request an opt out in writing. We do not sell or license your media to third parties.
Unless otherwise specified, services include a limited number of reasonable revisions based on the original instructions. Once Delivered Media has been accepted or downloaded, the order is considered complete.
All prices are displayed at the time of checkout. Payments are processed through Stripe, a third party payment processor. Orders are not started until payment is received.
Due to the nature of digital media services:
If an error occurs due to our failure to follow the original instructions, we will make reasonable efforts to correct it.
Estimated delivery times are provided for convenience and general planning purposes only and are not guaranteed. Work is completed in the order received, and delivery may be delayed due to revision requests, scope changes, unusually high order volume, technical complexity, or circumstances beyond our control. We will make reasonable efforts to communicate anticipated delays when practicable.
To the maximum extent permitted by law, Kaleidosky Studio shall not be liable for indirect, incidental, or consequential damages. Liability shall not exceed the amount paid for the specific service giving rise to the claim. We do not guarantee specific marketing outcomes, sale prices, or listing performance.
You agree to indemnify and hold harmless Kaleidosky Studio from any claims, damages, or expenses arising from your submitted content; your misuse of Delivered Media; or violation of these Terms.
We reserve the right to refuse service or terminate an order if submitted content violates these Terms or applicable laws.
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be brought exclusively in the state or federal courts located in Houston, Texas.
We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms.
